Wedding Filmmaking Services Agreement

This agreement outlines the terms, expectations, creative rights, payment obligations, delivery standards, and client usage permissions for wedding filmmaking services provided by Lumiére Film House.

This Wedding Filmmaking Services Agreement “Agreement” is entered into by and between Lumiére Film House “Lumiére” and the client or clients purchasing wedding filmmaking services “Client.” By booking services with Lumiére, Client confirms that they have read, understood, and accepted the terms set forth herein.

1. Services

Lumiére agrees to provide wedding filmmaking services for Client on the event date specified in the booking proposal, invoice, or related service document. Services may include, but are not limited to:

  • Wedding highlight films
  • Candid wedding footage
  • Ceremony coverage
  • Reception coverage
  • Drone footage, where legally permitted and weather permitting
  • Additional services purchased by Client

The specific services, coverage hours, deliverables, and pricing are outlined in Client’s booking proposal or invoice and are incorporated into this Agreement by reference.

2. Creative Control

Client acknowledges that Lumiére is hired for its distinctive artistic style, elevated visual approach, and cinematic storytelling. Lumiére retains full creative discretion regarding filming techniques, camera placement, editing style, color grading, music selection, narrative structure, film length, and shot selection.

The final product shall reflect Lumiére’s artistic judgment and professional standards. Client understands that Lumiére is not obligated to include any specific moment, individual, speech, song, or event unless otherwise agreed to in writing.

3. Film Length

The estimated lengths of wedding films displayed on Lumiére’s website are general guidelines. The final delivered film will meet or reasonably approximate the advertised minimum length associated with the purchased package and may exceed the estimated duration at Lumiére’s discretion.

Film length shall be determined by storytelling needs, artistic judgment, available footage, and the overall quality of the final work. Film length alone shall not constitute grounds for refund, dispute, or additional editing.

4. Delivery Timeline

Lumiére will make commercially reasonable efforts to deliver the final wedding film or films within thirty (30) calendar days after the wedding date.

Delivery timelines may be extended due to force majeure events, illness or injury, equipment failure, acts of government, natural disasters, internet outages, or circumstances beyond Lumiére’s reasonable control. In such cases, Lumiére shall not be liable for delays and will communicate revised delivery expectations to Client.

5. Revision Policy

One (1) minor revision request is included with wedding film services. To qualify, the revision request must be submitted in writing, received within fourteen (14) days of delivery, and limited to reasonable editing adjustments.

Examples of minor revisions include:

  • Small clip substitutions
  • Minor title corrections
  • Minor audio adjustments

The following are not considered minor revisions:

  • Complete re-edits
  • Changes to storytelling structure
  • Music replacement requests
  • Changes to artistic style
  • Requests requiring extensive re-editing

Additional revisions may be billed at Lumiére’s current hourly editing rate.

6. Fees and Payment

Retainer

A non-refundable retainer equal to thirty percent (30%) of the total wedding film services fee is required to reserve the event date. No date is secured until both the retainer and signed Agreement are received by Lumiére.

Remaining Balance

The remaining balance shall be paid according to the payment schedule provided by Lumiére. Lumiére reserves the right to withhold delivery of all products until full payment has been received.

Late Payments

Any payment more than seven (7) days overdue may incur a late fee of five percent (5%) per month, or the maximum amount permitted by law, whichever is less.

7. Cancellation

If Client cancels services for any reason, the thirty percent (30%) retainer shall remain non-refundable. Any additional payments beyond the non-refundable retainer may be refunded at Lumiére’s discretion, less incurred expenses, administrative costs, and completed work.

All cancellations must be submitted in writing.

8. Rescheduling

Client may request to reschedule the wedding date. Lumiére reserves the right, in its sole discretion, to approve or deny any rescheduling request.

If approved, a rescheduling fee equal to twenty percent (20%) of the total wedding film services fee shall apply. The new date must be mutually agreed upon. Existing pricing and package terms may be adjusted if necessary.

If Lumiére is unavailable for the requested date, the rescheduling request may be denied without liability.

9. Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, severe weather, fire, flood, pandemic, government restrictions, terrorism, labor disputes, transportation interruptions, power outages, internet failures, illness, injury, or death.

In such circumstances, Lumiére may extend performance deadlines, including delivery timelines, without penalty.

10. Client Responsibilities

Client shall ensure cooperation from all vendors, provide an accurate event timeline, and notify Lumiére of any venue, religious, logistical, or filming restrictions before the wedding date.

Lumiére shall not be responsible for missed footage caused by schedule delays, venue restrictions, guest interference, uncooperative participants, inaccurate timelines, or circumstances outside Lumiére’s control.

12. Ownership

All footage, edits, project files, raw footage, working files, and final films remain the intellectual property of Lumiére Film House. Client receives a personal-use license as described in this Agreement. Ownership is not transferred under this Agreement.

13. Client Usage License

Upon full payment, Client receives a non-exclusive, non-transferable license to view the films, download the films, share the films with family and friends, and post the films on personal social media accounts.

Client may not sell the films, license the films, substantially alter the films, remove Lumiére branding when present, or submit the films for commercial use without written consent. Any commercial use requires prior written approval from Lumiére.

14. Raw Footage

Raw footage is not included unless expressly purchased. Lumiére is under no obligation to release raw footage. If raw footage is purchased, Lumiére may provide the footage in its existing format without color correction, audio processing, stabilization, editing, or additional organization.

15. Model Release

Client grants Lumiére irrevocable permission to photograph and film the event and to use names, likenesses, voices, images, and appearances captured in the footage for portfolio purposes, website content, social media, advertising, marketing, industry competitions, and educational presentations.

No additional compensation shall be due. If Client desires a privacy restriction, such request must be agreed upon in writing before the event and may require an additional fee.

16. Limitation of Liability

Lumiére’s total liability under this Agreement shall not exceed the amount paid by Client for wedding film services. Under no circumstances shall Lumiére be liable for emotional distress, indirect damages, consequential damages, lost opportunities, lost profits, or third-party claims.

17. Equipment Failure and Data Loss

While Lumiére employs professional backup procedures, equipment failures, corrupted files, data loss, or unforeseen technical issues may occur. In the event of total loss of deliverables caused by circumstances beyond Lumiére’s reasonable control, Lumiére’s liability shall be limited to a refund of payments received.

18. Governing Law

This Agreement shall be governed by the laws of the State of Tennessee. Any disputes arising under or related to this Agreement shall be resolved in the courts located in Tennessee.

19. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior discussions, communications, or agreements. Any amendments must be made in writing and signed by both parties.

By booking wedding filmmaking services with Lumiére Film House, Client acknowledges that they have read, understood, and agreed to the terms of this Wedding Filmmaking Services Agreement.
